Description of Practice

Attorney Benjamin Papa's mediation practice is focused on the areas of family law, elder law, and estate related disputes. Specific examples include divorce, post-divorce disputes, domestic partnership dissolutions, estate disputes, elder mediations, and other family mediation services such as parent/child conflict, house rules, and division of labor. He also has particular training and skills in church and other religious organization mediations.

Professional Background

Mr. Papa is an Attorney licensed to practice in Tennessee and his entire law and mediation practice is limited to the areas of family law and probate. He completed a training program in family and divorce mediation in 2003 and is recognized by the TN Supreme Court as a Rule 31 mediator for family cases, including those involving domestic violence. He is also trained as a parent coordinator through the Association of Family and Conciliation Courts. Ben is trained through the Lombard Mennonite Peace Center to conduct mediations with churches and other religious organizations.


Mr. Papa was trained as a family mediator in April 2003. He added Collaborative Divorce to his practice in 2009. Across his career, he has helped hundreds of families resolve family-related conflicts, including issues related to divorce, post-divorce disputes, and domestic partner dissolutions, primarily using the processes of negotiated settlement, collaborative divorce, and mediation. He regularly attends both legal and mediation-related continuing education programs.


Mr. Papa earned a B.A. in Psychology from Vanderbilt University; J.D. from The Ohio State University College of Law; and a Master of Divinity (M.Div.) from Vanderbilt Divinity School.

Mr. Papa's approach to family legal issues depends on the nature of the case and the needs of his clients. Generally, he tries to take a problem solving approach to all of his cases, recognizing that family law disputes almost always include legal, financial, and emotional issues all of which need to be addressed in some way in order to meet the family's needs. When mediating, he typically utilizes the facilitative/solution-focused model of mediation practice. Mr. Papa is particularly committed to helping his clients come to agreements that stand the test of time and that avoid future conflict.

In addition to mediation and Collaborative Divorce services, Mr. Papa also represents clients in adoptions, surrogacy agreements, and probate. He also trains other professionals to become Collaborative Divorce practitioners through his work with Interdisciplinary Collaborative Divorce Trainers ( Mr. Papa is a member of the Tennessee Association of Professional Mediators, Tennessee Bar Association (Family Law and ADR Sections), Nashville Bar Association (Domestic Relations section), Academy of Professional Family Mediators, International Association of Collaborative Professionals, and the Middle Tennessee Collaborative Alliance (Founding President).
